Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 30-A MRSA §2006 is enacted to read:

 
§2006.__Sale of acquired property

 
1.__Proof of ownership.__Before a municipality may sell
acquired property, the municipality shall provide the purchaser
proof of ownership of the property.

 
2.__Misrepresentation.__If, at a later date, it is proven that
the municipality misrepresented ownership of the property, the
municipality shall refund to the injured party all costs
incurred, including any legal fees, as a result of the
misrepresentation of ownership.

 
SUMMARY

 
This bill requires a municipality to provide proof of
ownership of acquired property before the municipality can sell
the property. The bill also requires the municipality to pay all
costs to the injured party if the municipality misrepresented
ownership of the property.
