G.__"Late enrollee" means an eligible employee or dependent
who requests enrollment in a small group health plan
following the initial minimum 30-day enrollment period
provided under the terms of the plan, except that an
eligible employee or dependent is not considered a late
enrollee if the eligible employee or dependent meets the
requirements of section 2849-B, subsection 3, paragraph A,
B, C-1 or D.

 
H.__"New business premium rate" means, for each class of
business as to a rating period, the premium rate charged or
offered by the carrier to small employers with similar case
characteristics for newly issued health benefit plans with
the same or similar coverage.

 
I.__"Rating period" means the calendar period for which the
premium rates established by a carrier are assumed to be in
effect as determined by the carrier.

 
J.__"Small employer" means any person, firm, corporation,
partnership or association actively engaged in business
that, on at least 50% of its working days during the
preceding year, employed no more than 50 eligible employees
and at least 2 eligible employees. In determining the number
of eligible employees, companies that are affiliated
companies or that are eligible to file a combined tax return
for purposes of state taxation must be considered one
employer.

 
K.__"Small group health plan" means any hospital and medical
expense-incurred policy; health, hospital or medical service
corporation plan contract; or health maintenance
organization subscriber contract covering an eligible group.__
"Small group health plan" does not include the following
types of insurance:

 
(1)__Accident;

 
(2)__Credit;

 
(3)__Disability;

 
(4)__Long-term care or nursing home care;

 
(5)__Medicare supplement;

 
(6)__Specified disease;

 
(7)__Dental or vision;
