Sec. 1. 34-A MRSA c. 17 is enacted to read:

CHAPTER 17

ARSONIST REGISTRATION ACT

§11301.__Short title

This chapter may be known and cited as "the Arsonist Registration Act."

§11302.__Definitions

As used in this chapter, unless the context otherwise indicates, the following terms have the following meanings.

1.__Arsonist.__"Arsonist" means a person who is convicted of one of the following offenses or of an attempt or solicitation of one of the following offenses:

A.__A violation under Title 17-A, section 802, 803-A or 804 or chapter 41;

B.__A violation under former Title 17, chapter 7, 8 or 21; or

C.__An offense in another jurisdiction, including, but not limited to, a state, federal, military or tribal court, that includes the essential elements of an offense listed in paragraph A or B;

For purposes of this subsection, "arsonist" also means a person who was found not criminally responsible by reason of mental disease or defect for an offense under paragraph A or B pursuant to Title 17-A, section 40 or who was found not guilty by reason of insanity or similar provision for an offense under paragraph C.__"Arsonist" includes a person adjudicated as a juvenile in the State or another jurisdiction that includes the essential elements of an offense listed in paragraph A or B.

2. Arson offense.__"Arson offense" includes any offense listed under subsection 1, paragraph A, B or C.

3.__Bureau.__"Bureau" means the State Bureau of Identification.

4. Law enforcement agency having jurisdiction.__"Law enforcement agency having jurisdiction" means the chief of police
