Sec. LLL-1. Transfers of funds. Notwithstanding any other provision of law, the State Controller shall transfer $519,209 from the Rehabilitation Services - Medicaid account in the Department of Labor to the unappropriated surplus of the General Fund on or before June 30, 2005.

PART MMM

Sec. MMM-1. 37-B MRSA §157, sub-§§4, 5 and 6 are enacted to read:

4.__Fund flexibility and adjustments.__Notwithstanding the provisions of Title 5, section 1585, in order to provide sufficient flexibility to adjust to market forces, adjustments to the Maine Military Authority Enterprise Fund may be made through financial orders recommended to the Governor by the State Budget Officer.

5.__No obligation of state funds.__If revenues or other sources of operating funds are not sufficient or available as anticipated for the Maine Military Authority Enterprise Fund, there is no obligation to provide state funds.

6.__Quarterly reports.__The Maine Military Authority shall provide quarterly financial statements regarding the Maine Military Authority Enterprise Fund in a format prescribed by the State Controller to the joint standing committee of the Legislature having jurisdiction over appropriations and financial affairs and the joint standing committee of the Legislature having jurisdiction over the Maine Military Authority.

Sec. MMM-2. 37-B MRSA §394, sub-§4, as enacted by PL 2003, c. 646, §9, is amended to read:

4. Establish positions. By financial order, the Adjutant General may establish positions necessary to support the operations of the Maine Readiness Sustainment Center in Limestone or to maintain, repair, store and manufacture equipment under section 157. In order for a position that is established by financial order to become permanent, it must be presented to the next session of the Legislature through the normal budgetary process.
