be required to give an appeal bond in an appeal that relates to a | cause of action arising under this chapter. |

| | 16. Issuance of substitute coverage. In carrying out its | duties in connection with guaranteeing, assuming or reinsuring | policies or contracts under this section, the association may, | subject__to approval of the receivership court, issue substitute | coverage for a policy or contract that provides an interest rate, | crediting rate or similar factor determined by use of an index or | other external reference stated in the policy or contract | employed in calculating returns or changes in value by issuing an | alternative policy or contract in accordance with this | subsection. |

| A. In lieu of the index or other external reference provided | for in the original policy or contract, the alternative | policy or contract must provide for: |
|
| (1) A fixed interest rate; |
|
| (2) Payment or dividends with minimum guarantees;__or |
|
| (3) A different method for calculating interest or | changes in value. |
|
| B. There may not be a requirement for evidence of | insurability, waiting period or other exclusion that would | not have applied under the replaced policy or contract. |
|
| C. The alternative policy or contract must be substantially | similar to the replaced policy or contract in all other | material terms. |
|
| | Sec. 7. 24-A MRSA §4609, as amended by PL 1989, c. 751, §12, is | further amended to read: |
|
| | 1. Assessments; collection. For the purpose of providing the | funds necessary to carry out the powers and duties of the | association, the board of directors shall assess the member | insurers, separately for each account, at such times and for such | amounts as the board finds necessary. The board shall collect the | assessments after 30 days' written notice to the member insurers | before payment is due. Assessments are due not less than 30 days | after prior written notice to the member insurers and accrue | interest at 10% annually on and after the due date. |

| | 2. Classes of assessments. There shall be 5 classes of | assessments, as follows. |
