CHAPTER 433

An Act To Amend the Motor Vehicle Laws

 
Emergency preamble. Whereas, acts of the Legislature do not become
effective until 90 days after adjournment unless enacted as
emergencies; and

 
Whereas, this legislation needs to take effect before the
expiration of the 90-day period in order to ensure the State is
in compliance with the federal Motor Carrier Safety Improvement
Act of 1999, Public Law 106-159, 113 Stat. 1748 by September 30,
2005 as required by federal law; and

 
Whereas, in the judgment of the Legislature, these facts create
an emergency within the meaning of the Constitution of Maine and
require the following legislation as immediately necessary for
the preservation of the public peace, health and safety; now,
therefore,

 
Be it enacted by the People of the State of Maine as follows:

 
Sec. 1. 24-A MRSA §2187, sub-§1, ¶B, as enacted by PL 1997, c. 675, §2
and amended by PL 2001, c. 44, §11 and affected by §14, is
further amended to read:

 
B. "Authorized agency" or "authorized agencies" means:

 
(1) The Attorney General;

 
(2) A district attorney responsible for prosecution in
the municipality where the fraud occurred;
