| Sec. CCCC-1. Reimbursement of heating costs. Notwithstanding any |
| provision of law or rule to the contrary, the Department of |
| Health and Human Services shall amend its rules for the |
| reimbursement of nursing facilities and residential care |
| facilities to provide a one-time payment for increased heating |
| costs incurred during the 2005-2006 heating season for nursing |
| facilities and residential care facilities to be paid before July |
| 1, 2006. The amount of $400,000 appropriated from the General |
| Fund for this purpose must be used to reimburse residential care |
| facilities for increased heating costs, regardless of any |
| limitation otherwise applicable to reimbursement for residential |
| care facilities. The amount of $300,000 allocated from Other |
| Special Revenue Funds for this purpose must be used as the state |
| share of Medicaid reimbursement, to be matched by federal |
| financial participation funds, to reimburse nursing facilities |
| for increased heating costs, regardless of any limitation or cap |
| on routine costs otherwise applicable to the reimbursement for |
| nursing facilities. If the full costs of heating for the 2005- |
| 2006 heating season cannot be met with the funds appropriated and |
| allocated under this Part, the Department of Health and Human |
| Services shall distribute the funds appropriated in this Part in |
| proportion to the share of the total annual heating costs of |
| these facilities funded through the General Fund that are set |
| forth in each facility's recent MaineCare audited cost report for |
| its fiscal year ending in 2004. If the MaineCare audit for 2004 |
| has not been completed at the time of calculating the |
| distribution of funds under this section, then the cost report |
| for the fiscal year ending in 2004 as filed with the Department |
| of Health and Human Services must be used. Rules adopted |
| pursuant to this section are routine technical rules as defined |
| in the Maine Revised Statutes, Title 5, chapter 375, subchapter |
