7.__Enforcement by court; further civil fine.__If a person does not comply with an order under this section, the administrator may request that the Attorney General petition a court of competent jurisdiction to enforce the order. The court may not require the administrator to post a bond in an action or proceeding under this section. If the court finds, after service and opportunity for hearing, that the person was not in compliance with the order, the court may adjudge the person in contempt of the order. The court may impose a further civil fine against the person for contempt in an amount not to exceed $10,000 per violation and may grant any other relief the court determines is just and proper in the circumstances.

8.__Appointment of presiding officer.__For purposes of any hearing conducted pursuant to this section, the administrator may appoint a qualified person to preside at the hearing and to make proposed findings of fact and conclusions of law. The responsibility for the entry of the final findings of fact and conclusions of law and for the issuance of any final order remain with the administrator.

§16605.__Rules, forms, orders, interpretative opinions and

hearings

1.__Issuance and adoption of forms, orders and rules.__In addition to specific authority granted elsewhere in this chapter, the administrator may:

A.__Issue forms and orders and, after notice and comment, adopt and amend rules necessary or appropriate to carry out this chapter and may repeal rules, including rules and forms governing registration statements, applications, notice filings, reports and other records;

B.__By rule, define terms, whether or not used in this chapter, but those definitions may not be inconsistent with this chapter; and

C.__By rule, classify securities, persons and transactions and adopt different requirements for different classes.
