| Sec. B-1. Adoption of rules. The major substantive rules adopting the |
| unified eligibility provisions for early childhood special |
| education and other special education programs for eligible |
| persons from birth to 20 years of age, pursuant to the Maine |
| Revised Statutes, Title 20-A, section 7005, subsection 1, must be |
| presented by the Department of Education for legislative review |
| in the First Regular Session of the 123rd Legislature, except |
| that the Commissioner of Education may adopt a rule for the |
| unified eligibility provisions for early childhood special |
| education and other special education programs for eligible |
| persons from birth to 20 years of age for the state fiscal year |
| 2006-07 as an emergency rule pursuant to Title 5, section 8073. |
| Notwithstanding Title 5, section 8052, subsection 1, the |
| Department of Education must hold a public hearing on the |
| emergency, major substantive rule adopted pursuant to this |
| section. The commissioner shall report to the joint standing |
| committee of the Legislature having jurisdiction over education |
| and cultural affairs by February 15, 2007 on the emergency, major |
| substantive rule established for fiscal year 2006-07. |
