Amend the amendment in section 2 in §1695 in subsection 2 by inserting at the end a new blocked paragraph to read:
‘ The manufacturer or distributor of a children's product that contains a priority chemical may provide additional information to the department regarding the potential for harm to human health and the environment from specific uses of the priority chemical.’
Amend the amendment in section 2 in §1696 in subsection 1 in paragraph B in the first line (page 5, line 10 in amendment) by inserting after the following: " available" the following: ' at a comparable cost'
Amend the amendment in section 2 in §1697 by striking out all of subsection 2 (page 6, lines 29 and 30 in amendment) and inserting the following:
‘ 2. Industry. The requirements of this chapter do not apply to priority chemicals used in or for industry or manufacturing, including chemicals processed or otherwise used in or for industrial or manufacturing processes.’
Amend the amendment in section 2 in §1697 in subsection 3 in the first line (page 6, line 31 in amendment) by striking out the following: " Vehicles." and inserting the following: ' Transportation.'
Amend the amendment in section 2 in §1697 in subsection 3 in the 2nd line (page 6, line 32 in amendment) by inserting after the following: " subsection 42" the following: ' or watercraft as defined in Title 12, section 13001, subsection 28'
Amend the amendment in section 2 in §1697 by inserting after subsection 6 the following:
‘ 7. Food and beverage packaging. A container or packaging for a food or beverage product is exempt from the requirements of this chapter, unless that product is intentionally marketed or intended for the use of children under 3 years of age.’
SUMMARY
This amendment amends Committee Amendment "A" by clarifying the definition of "consumer product" to exclude paper or forest products. It allows additional information on priority chemicals to be provided by the manufacturer and distributor of children's products. It clarifies application of the new law on priority chemicals used in industry. It adds an exemption for watercraft. It also clarifies that the requirements are not exempt for packaging food and beverage products for the use of children under 3 years of age.
