Amend the bill by striking out the title and substituting the following:

‘An Act To Prevent Retailers from Selling Malt Liquor and Wine below Cost’

Amend the bill by striking out everything after the enacting clause and before the summary and inserting the following:

Sec. 1. 28-A MRSA §1201, sub-§8  is enacted to read:

8 Sale of malt liquor and wine below cost.   A person licensed under this section may not sell malt liquor or wine at a retail price that is less than the cost to the licensee to purchase that malt liquor or wine from a wholesale licensee.

This amendment changes the provision in the bill that would prohibit the sale of liquor below cost. The provision now would apply only to malt liquor and wine sold for consumption off-premises. The amendment specifies that a licensee may not sell malt liquor or wine at a retail price that is less than the cost to the licensee to purchase that malt liquor or wine from a wholesaler.
