An Act Relative to Motor Vehicles and Floats Operated in Parades

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 29-A MRSA §2081, sub-§6,  as amended by PL 1997, c. 450, §4, is further amended to read:

6. Exceptions.   Notwithstanding subsection subsections 2, 3 and 3-A:
A.  A rural mail carrier of the United States Postal Service is not required to be secured in a seat belt while engaged in the delivery of mail; and
B.  The operator of a taxicab or a limousine is not responsible for securing in a seat belt a passenger transported for a fee . ; and
C A person operating a vehicle or float in a parade is not responsible for securing in a seat belt a passenger who is being transported as part of the parade, as long as the vehicle or float is traveling at a speed of no more than 10 miles per hour and, if a float, the float is equipped with a continuous railing enclosing the perimeter of the platform, 3 feet or more in height and enclosed in a way that would reasonably prevent passage of a child.

This bill exempts a person operating a vehicle or a float in a parade from the obligation to secure passengers in seat belts.
