An Act To Limit the Use of Seaplanes on West Harbor Pond
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 12 MRSA §13001, sub-§24-A is enacted to read:
24-A. Seaplane. "Seaplane" means a fixed-wing aircraft capable of taking off from and landing on water.
Sec. 2. 12 MRSA §13074 is enacted to read:
1. Pond. A person may not operate a seaplane on West Harbor Pond in Boothbay Harbor.
2. Exempt. A person who owns land on West Harbor Pond may operate a seaplane on that pond for occasional personal or recreational use.
3. Penalty. The penalties in this subsection apply to violations of this section. A. A person who violates this section commits a civil violation for which a fine of not less than $100 nor more than $500 may be adjudged.
B. A person who violates this section after having been adjudicated as having committed 3 or more civil violations under this Part within the previous 5-year period commits a Class E crime.
Sec. 3. Maine Revised Statutes headnote amended; revision clause. In the Maine Revised Statutes, Title 12, chapter 935, in the chapter headnote, the words "watercraft and airmobiles" are amended to read "watercraft, airmobiles and seaplanes" and the Revisor of Statutes shall implement this revision when updating, publishing or republishing the statutes.
