	Requiring local school administrative units to 1) provide physical education to students daily; 2) provide a program of physical evaluation of each student and; 3) increase the number of required annual schools days by 10 is a state mandate pursuant to the Constitution of Maine.  Unless General Fund appropriations are provided to fund at least 90% of the additional costs or a Mandate Preamble is amended to the bill and two-thirds of the members of each House vote to exempt this mandate from the funding requirement, the local school administrative units may not be required to implement these changes. Fiscal Detail and Notes
	The General Purpose Aid for Local Schools program within the Department of Education will require additional ongoing General Fund appropriations of $48,357,031 in fiscal year 2009-10 and $54,027,789 in fiscal year 2010-11 for the costs associated with increasing the number of required school days from 180 days a year to 190 days a year.  This estimate assumes that the State funds 51.01% of 97% of the total state and local costs of K-12 public education in fiscal year 2009-10 and 55% of 100% of the total state and local costs beginning in fiscal year 2010-11.
	Additional costs to local school administrative units associated with increasing the number of required annual school days by 10 is estimated to be $46,442,089 in fiscal year 2009-10 and $44,204,555 in fiscal year 2010-11.   The fiscal impact to local school administrative units to provide physical education to students on a daily basis and to provide a program of physical evaluation of each student can not be determined at this time.
