| Requiring local school administrative units to 1) provide physical education to students daily; 2) provide a program of physical evaluation of each student and; 3) increase the number of required annual schools days by 10 is a state mandate pursuant to the Constitution of Maine. Unless General Fund appropriations are provided to fund at least 90% of the additional costs or a Mandate Preamble is amended to the bill and two-thirds of the members of each House vote to exempt this mandate from the funding requirement, the local school administrative units may not be required to implement these changes. | School | Significant | ||||

| The General Purpose Aid for Local Schools program within the Department of Education will require additional ongoing General Fund appropriations of $48,357,031 in fiscal year 2009-10 and $54,027,789 in fiscal year 2010-11 for the costs associated with increasing the number of required school days from 180 days a year to 190 days a year. This estimate assumes that the State funds 51.01% of 97% of the total state and local costs of K-12 public education in fiscal year 2009-10 and 55% of 100% of the total state and local costs beginning in fiscal year 2010-11. | ||||||
| Additional costs to local school administrative units associated with increasing the number of required annual school days by 10 is estimated to be $46,442,089 in fiscal year 2009-10 and $44,204,555 in fiscal year 2010-11. The fiscal impact to local school administrative units to provide physical education to students on a daily basis and to provide a program of physical evaluation of each student can not be determined at this time. | ||||||
