An Act Regarding Agencies Contracted by the Department of Health and Human Services To Provide Regulatory Oversight and Billing Services

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 22 MRSA §42, sub-§10  is enacted to read:

10 Requirements for contracts for regulatory oversight and billing services.   The department shall adopt rules regarding contracts for regulatory oversight and billing services for service providers. The rules must require that, prior to signing the contract and once per year after the date of signing, the department shall determine that the contractor has obtained financial securitization by insurance coverage or performance bond that meets or exceeds all of the anticipated financial obligations of the contractor, including all of the contractor’s obligations to all service providers for which the contractor will provide or is providing regulatory oversight or billing services and payment in full of all obligations of the contractor to all service providers if the contractor ceases doing business. Rules adopted pursuant to this subsection are routine technical rules as defined in Title 5, chapter 375, subchapter 2-A.

SUMMARY

This bill requires the Department of Health and Human Services to adopt rules regarding contracts for regulatory oversight and billing services for service providers to require proof that the contractor has obtained financial securitization for all financial obligations, even if the contractor ceases doing business.
