An Act To Strengthen Maine Small Business by Establishing a Preference Percentage for State Contract Bids

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 5 MRSA §1825-B, sub-§15  is enacted to read:

15 Preference for small businesses.   Notwithstanding any other provision of law to the contrary, the Director of the Bureau of General Services shall adopt rules establishing a preference percentage of up to 15% for a business:
A With 50 or fewer employees and gross sales of less than $5,000,000 within the most recent 12 months for which financial records are available;
B Whose principal place of business is located in the State;
C That pays a majority of its payroll to residents of the State; and
D That provides health and retirement benefits to its employees as determined in subsection 11.

Rules adopted pursuant to this subsection are routine technical rules as defined in chapter 375, subchapter 2-A.

This bill requires the Director of the Bureau of General Services within the Department of Administrative and Financial Services to adopt rules establishing a preference percentage of up to 15% for Maine small businesses bidding for state contracts. The rules are routine technical rules.
