An Act To Protect Persons in Residential Care Who Are under Limited Guardianship

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 22 MRSA §7801, sub-§6  is enacted to read:

6 Protection of persons under limited guardianship.   Beginning January 1, 2012, a residential care facility that is licensed under subsection 1 and that has as a resident a person who is the subject of a limited guardianship ordered pursuant to Title 18-A, section 5-105 as a condition of licensure or renewal of licensure shall certify that the administrator of the residential care facility is knowledgeable about and understands the nature of limited guardianship.

SUMMARY

This bill requires licensed residential care facilities that have as residents persons under limited guardianship under the Maine Revised Statutes, Title 18-A, section 5-105 to certify as a condition of licensure or renewal a knowledge and understanding of limited guardianship.
