An Act To Protect Medical Care Providers and Hospital Staff

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 17-A MRSA §752-C,  as enacted by PL 1997, c. 470, §1, is amended to read:

§ 752-C. Assault on a medical care provider

1.    A person is guilty of assault on an emergency a medical care provider if that person intentionally, knowingly or recklessly causes bodily injury to an emergency a medical care provider or the support staff of the medical provider while the emergency medical care provider is providing emergency medical care or after the medical care provider has provided medical care to the person or to someone to whom the person has a connection.
2.    As used in this section, " emergency medical care provider" includes hospital personnel assisting in an emergency and a licensed or unlicensed person who provides medical care in a hospital, health care facility or other professional setting, including an emergency medical services persons person, defined in Title 32, section 83, subsection 12. "Support staff of a medical provider" includes a person who provides direct support to a medical care provider or to a hospital or health care facility, including maintenance and janitorial personnel.
3.    Assault on an emergency a medical care provider is a Class C crime.

summary

This bill broadens the Class C offense of assault on an emergency medical care provider to include all medical care providers who are assaulted while providing medical care or after providing medical care by the person who was provided the medical care or by another person connected to such a person. This bill also broadens the offense to include an assault on medical care support staff, such as maintenance and janitorial personnel.
