An Act To Amend the Agency Liquor Store Laws

Sec. 1. 28-A MRSA §457-A  is enacted to read:

§ 457-A.  Relocation of agency liquor store

Upon application of a licensee under this chapter, the licensee's agency liquor store may relocate to a new location within the same municipality if notice under section 453-A, subsection 4 is given and the new location meets the criteria under section 453-A, subsection 5 as well as or better than the former location. A new location for an existing agency liquor store under this section may not be within 300 feet of another agency liquor store unless the former location of the agency liquor store was within 300 feet of another agency liquor store. An agency liquor store may not relocate under this section within 5 years of previously relocating under this section.

This bill allows the relocation of an agency liquor store within the same municipality as the old location if notice is given to the municipality, the new location meets or exceeds the licensing criteria of the old location, the new location is not within 300 feet of another agency liquor store unless the old location was within 300 feet of another agency liquor store and the store has not relocated within the previous 5-year period.
