An Act Regarding Motorcycle Proof of Inspection

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 29-A MRSA §355  is enacted to read:

§ 355 Motorcycle registration

1 Registration.   Notwithstanding section 351, a person may not register a motorcycle unless the person satisfies the Secretary of State that the motorcycle is inspected pursuant to section 1751 and covered by a liability insurance policy as established according to section 402, subsection 2.
2 Requirement.   After January 1, 2012, a person shall have a motorcycle registered and inspected within the same month.

Sec. 2. 29-A MRSA §1758, sub-§3,  as enacted by PL 2009, c. 624, §2 and affected by §4, is repealed.

Sec. 3. Prorated inspections. The Secretary of State shall implement a system that allows for an initial term of inspection that may be for less than one year in order that the following renewal of inspection falls in the same month as the renewal date for the motorcycle's registration. The system must allow for a proration of the initial inspection fee to reflect a term of less than one year.

This bill requires a person to have a motorcycle inspected and insured prior to registering the motorcycle. The bill also requires that the inspection and registration take place during the same month. The bill requires the Secretary of State to implement a system that allows for the synchronization of motorcycle inspection and registration renewals.
