An Act To Limit the Use of Social Security Numbers by State Agencies

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 5 MRSA §58  is enacted to read:

§ 58 Prohibited use of social security numbers

1 Prohibition.   A state agency may not include an individual's social security number in written correspondence.
2 Exception.   This section does not apply to:
A Federal forms; or
B Tax forms under Title 36.
3 State agency.   For the purposes of this section, "state agency" means the State and any office, department, agency, authority, commission, board, institution, hospital or other instrumentality of the State, including the Maine Turnpike Authority, the Maine Port Authority, the Northern New England Passenger Rail Authority, the Maine Community College System, the Maine Veterans' Homes, the Maine Public Employees Retirement System, the Maine Military Authority and all such other state entities.

SUMMARY

This bill prohibits state agencies from including an individual's social security number in written correspondence. The prohibition does not apply to federal forms or tax forms. The bill defines "state agency" to mean the State and any office, department, agency, authority, commission, board, institution, hospital or other instrumentality of the State, including the Maine Turnpike Authority, the Maine Port Authority, the Northern New England Passenger Rail Authority, the Maine Community College System, the Maine Veterans' Homes, the Maine Public Employees Retirement System, the Maine Military Authority and all such other state entities.
