An Act To Move the Land for Maine's Future Program to the Department of Agriculture, Food and Rural Resources

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 5 MRSA §6202,  as enacted by PL 1987, c. 506, §§1 and 4, is repealed and the following enacted in its place:

§ 6202 Land for Maine's Future Board

The Land for Maine's Future Board, as established in section 12004-G, subsection 29 and referred to in this chapter as "the board," is an Executive Department Board located within the Department of Agriculture, Food and Rural Resources.

Sec. 2. 5 MRSA §6204, sub-§1,  as amended by PL 1993, c. 728, §6, is further amended to read:

1. Composition.   The board consists of 11 10 members, 6 who are private citizens and 5 4 who are permanent members. The permanent members are the Commissioner of Conservation; the Commissioner of Inland Fisheries and Wildlife; the Commissioner of Marine Resources; and the Commissioner of Agriculture, Food and Rural Resources ; and the Director of the State Planning Office.

Sec. 3. 5 MRSA §6204, sub-§6,  as amended by PL 1993, c. 728, §6, is further amended to read:

6. Assistance.   The Department of Conservation; the Department of Inland Fisheries and Wildlife; the Department of Transportation; the Department of Agriculture, Food and Rural Resources; the State Planning Office; and all other state agencies shall provide staff support and assistance considered necessary by the board to fulfill the objectives of this chapter. If agency assistance is not available, consultants may be hired from the proceeds of either the Land for Maine's Future Fund or the Public Access to Maine Waters Fund to assist the board in carrying out its responsibilities.

Sec. 4. Transition provisions. The following provisions govern the transfer of responsibilities for providing administrative support to the Land for Maine's Future Board from the Executive Department, State Planning Office to the Department of Agriculture, Food and Rural Resources.

1. Any positions authorized and allocated to the State Planning Office in support of the Land for Maine's Future Board and administration of the Land for Maine's Future Fund and the Public Access to Maine Waters Fund are transferred to the Department of Agriculture, Food and Rural Resources and may continue to be authorized.

2. All records, property and equipment previously belonging to or allocated for the use of the State Planning Office in support of the Land for Maine's Future Board become, on the effective date of this Act, the property of the Department of Agriculture, Food and Rural Resources.

3. Any existing contracts, agreements or compacts entered into by the Director of the State Planning Office or the Executive Director of the Land for Maine's Future Program continue in effect.
