Amend the bill by striking out the title and substituting the following:

‘An Act To Move the Land for Maine's Future Program to the Department of Conservation’

Amend the bill in section 1 in §6202 in the last line (page 1, line 7 in L.D.) by striking out the following: " Agriculture, Food and Rural Resources" and inserting the following: ' Conservation'

Amend the bill by striking out all of section 2 (page 1, lines 8 to 14 in L.D.) and inserting the following:

Sec. 2. 5 MRSA §6204, sub-§1,  as amended by PL 1993, c. 728, §6, is further amended to read:

1. Composition.   The board consists of 11 members, 6 7 who are private citizens and 5 4 who are permanent members. The permanent members are the Commissioner of Conservation; the Commissioner of Inland Fisheries and Wildlife; the Commissioner of Marine Resources; and the Commissioner of Agriculture, Food and Rural Resources ; and the Director of the State Planning Office.

Sec. 3. 5 MRSA §6204, sub-§2,  as amended by PL 1999, c. 603, §3, is further amended to read:

2. Appointments.   The 6 7 private citizens are appointed by the Governor, subject to review by the joint standing committee of the Legislature having jurisdiction over matters pertaining to state parks and public lands and to confirmation by the Legislature.

Sec. 4. 5 MRSA §6204, sub-§3,  as amended by PL 1993, c. 728, §6, is further amended to read:

3. Qualifications.   The 6 7 private citizens must be selected for their knowledge of the State's natural resources and landscape and their demonstrated commitment to land conservation. Appointments must provide broad geographic representation.’

Amend the bill by inserting after section 3 the following:

Sec. 4. 36 MRSA §1140-B, sub-§1,  as enacted by PL 2007, c. 466, Pt. A, §58, is amended to read:

1. Analysis.  The State Tax Assessor, in consultation with municipal assessors, the director of the Land for Maine's Future Program within the Executive Department, State Planning Office Department of Conservation, representatives of working waterfront organizations and other interested parties, shall collect and analyze the sales prices of all actual sales that occur in the State of waterfront land that is subject to restrictions on that land's use that are legally enforceable and prohibit or substantially restrict development that is not commercial fishing activity or commercial activity that is the functional equivalent of commercial fishing activity.’

Amend the bill in section 4 in the 3rd and 4th lines (page 1, lines 26 and 27 in L.D.) by striking out the following: "Agriculture, Food and Rural Resources" and inserting the following: 'Conservation'

Amend the bill in section 4 in subsection 1 in the last line (page 1, line 31 in L.D.) by striking out the following: "Agriculture, Food and Rural Resources" and inserting the following: 'Conservation'

Amend the bill in section 4 in subsection 2 in the 3rd and 4th lines (page 1, lines 34 and 35 in L.D.) by striking out the following: "Agriculture, Food and Rural Resources" and inserting the following: 'Conservation'

Amend the bill by inserting at the end before the summary the following:

Sec. 5. Appropriations and allocations. The following appropriations and allocations are made.

This amendment is the minority report of the Joint Standing Committee on Agriculture, Conservation and Forestry. It transfers responsibility for and resources in support of the Land for Maine's Future Board and Land for Maine's Future Program from the Executive Department, State Planning Office to the Department of Conservation, instead of, as in the bill, to the Department of Agriculture, Food and Rural Resources. It adds as a member of the board a private citizen appointed by the Governor. The amendment also adds an appropriations and allocations section.
