Amend the amendment by inserting after section 5 the following:

Sec. 6. 10 MRSA §9724, sub-§1-B  is enacted to read:

1-B Municipalities with fewer than 5,000 residents.   A municipality with fewer than 5,000 residents may adopt a local building code, the Maine Uniform Building Code, the Maine Uniform Energy Code or the Maine Uniform Building and Energy Code. A municipality with fewer than 5,000 residents may choose not to adopt a building code. Notwithstanding any other provision of this chapter or Title 25, chapter 314, the provisions of the Maine Uniform Building Code, the Maine Uniform Energy Code or the Maine Uniform Building and Energy Code do not apply in a municipality that has fewer than 5,000 residents except to the extent the municipality has adopted that code pursuant to this subsection.

Amend the amendment in section 6 in the first paragraph in the 2nd line (page 2, line 23 in amendment) by striking out the following: " 4,000" and inserting the following: ' 10,000'

Amend the amendment in section 6 in the first paragraph in the 4th line (page 2, line 25 in amendment) by striking out the following: " 4,000" and inserting the following: ' 10,000'

Amend the amendment by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.

This amendment changes the threshold for municipalities that must adopt the Maine Uniform Building and Energy Code from municipalities with more than 4,000 residents, as proposed in Committee Amendment "A," to municipalities with more than 10,000 residents. It changes the threshold for municipalities that may not adopt or enforce a building code other than the Maine Uniform Building Code, the Maine Uniform Energy Code or the Maine Uniform Building and Energy Code from municipalities with up to 4,000 residents, as proposed in Committee Amendment "A," to municipalities with 5,000 to 10,000 residents. It provides that municipalities with fewer than 5,000 residents may adopt a local building code, the Maine Uniform Building Code, the Maine Uniform Energy Code or the Maine Uniform Building and Energy Code or may choose not to adopt a building code.
