Amend the amendment in the first paragraph after the title in the first 3 lines (page 1, lines 11 to 13 in amendment) by striking out the following: "in section 1 in the last indented paragraph in the last line (page 1, line 32 in L.D.) by striking out the following: "2-A." and inserting the following: '2-A; and be it further" and inserting the following: 'by striking out everything after the title and before the summary and inserting the following:

Sec. 1. Resolved: That, within the limits of its existing resources, the Department of Health and Human Services shall engage parties interested in the well-being of elderly and disabled adults for the purpose of creating a standard-form written contract that would satisfy existing MaineCare rules requiring a written contract for long-term care personal support services delivered by a relative in a home setting. The use of this contract form may not preclude the use of other forms. The Department of Health and Human Services shall post the contract form on its publicly accessible website, and shall adopt rules to implement the standard-form written contract. Rules adopted pursuant to this resolve are routine technical rules as defined in the Maine Revised Statutes, Title 5, chapter 375, subchapter 2-A.' ’

Amend the amendment by striking out all of the 2nd paragraph after the title and section 2 (page 1, lines 14 to 30 in amendment)

This amendment replaces the resolve. This amendment requires the Department of Health and Human Services to work with interested parties to create a standard-form written contract that may be used by an individual in need of long-term care services and supports to hire and pay a relative to provide that care. The amendment also clarifies that other forms may be used to accomplish the same purpose. It also requires the posting of this agreement on the publicly accessible website of the Department of Health and Human Services and requires the department to adopt routine technical rules relating to the standard-form written contract. Finally, the creation of the standard-form written contract and its posting on the department's website must be accomplished within the limits of existing resources.
