Amend the bill in section 2 in §9887-A in the first paragraph by striking out all of the first 2 underlined sentences (page 1, lines 23 to 27 in L.D.) and inserting the following: ' The department may impose on a person applying for transfer of supervision to another state under this compact an application fee of $100.'

Amend the bill in section 3 by striking out all of §9887-B (page 1, lines 38 to 40 and page 2, lines 1 to 4 in L.D.) and inserting the following:

§ 9887-B Biological sample for DNA analysis

A person accepted for supervision under this compact shall submit to having a DNA sample taken only if that person is convicted of a crime punishable by imprisonment for one year or more. The DNA sample may be taken at any time following commencement of the supervision period as directed by the person's probation officer. All other provisions of Title 25, chapter 194 govern the collection and use of the DNA sample as applicable.

Amend the bill by adding after section 3 the following:

Sec. 4. Appropriations and allocations. The following appropriations and allocations are made.

summary

This amendment changes the fee imposed on a person applying for transfer of supervision to another state under the Interstate Compact for Adult Offender Supervision from between $100 and $250 to a flat fee of $100. Instead of requiring a person accepted for supervision under the compact to submit to having a DNA sample taken if the offense has the essential elements of an offense in the Maine Revised Statutes, Title 25, section 1574, subsection 5, it limits the applicable offenses to those of a crime punishable by imprisonment for one year or more. The amendment also adds an appropriations and allocations section to the bill.
