An Act To Allow the Exchange of Scallop Licenses
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 12 MRSA §6706, sub-§5 is enacted to read:
5. License exchange. Notwithstanding subsections 1 and 2, a person who holds a hand fishing scallop license under section 6701 and a person who holds a scallop dragging license under section 6702 may exchange licenses. The commissioner shall adopt rules to implement this subsection. Rules adopted pursuant to this subsection are major substantive rules as defined in Title 5, chapter 375, subchapter 2-A.
Sec. 2. Rules. Rules adopted pursuant to the Maine Revised Statutes, Title 12, section 6706, subsection 5 must specify a limitation on the frequency and number of exchanges by a licensee and include provisions for the administration of that subsection.
