An Act To Exempt School Administrative Units That Do Not Directly Serve Children with Disabilities from Certain Reporting Requirements

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 20-A MRSA §7008  is enacted to read:

§ 7008 School administrative units without special education students

The commissioner may not require a school administrative unit to file reports regarding children with disabilities or special education services under this Part if:

1 No schools.   The school administrative unit does not operate any schools; or
2 Services provided by another reporting school administrative unit.   Any child with a disability under the jurisdiction of the school administrative unit is receiving special education services in another school administrative unit that is including that child in its reports.

This bill provides that the Commissioner of Education may not require a school administrative unit to file reports regarding special education if the unit does not operate schools or if special education services for the unit's children with disabilities are provided by another school administrative unit that includes those children in its reports.
