An Act To Increase the Penalties for Crimes Involving Illegal or Prescription Drugs

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 17-A MRSA §1160  is enacted to read:

§ 1160 Crimes involving illegal or prescription drugs

Notwithstanding the provisions of chapters 51 and 53, a person who is convicted of a crime other than a crime under Title 29-A, chapter 23 may receive for that crime up to twice the maximum term of imprisonment under chapter 51 and up to twice the maximum fine under chapter 53 if:

1   The crime involved the theft of illegal or prescription drugs; or
2   At the time of the commission of the crime the person was under the influence of a drug prohibited under chapter 45 or a drug that the person was not legally authorized to possess.

This bill doubles the maximum term of imprisonment and fine a person convicted of a crime may receive if the crime involved the theft of an illegal or prescription drug or the person committed the crime while under the influence of an illegal drug or a drug that the person was not legally authorized to possess.
