An Act To Limit the Amount a School Administrative Unit May Spend without Voter Approval

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 20-A MRSA §1351, sub-§1, ¶A,  as enacted by PL 1981, c. 693, §§5 and 8, is amended to read:

A. To approve the issuance of bonds or notes for school construction projects or, in the case of a project not involving the issuance of bonds or notes, to approve spending on any school construction project with a cost greater than $2,000,000;

Sec. 2. 20-A MRSA §15904, first ¶,  as amended by PL 1985, c. 248, §3, is further amended to read:

Prior to final approval by the state board, A school administrative unit may not spend any funds on a school construction project, other than a small scale school construction project, as defined in section 15901, subsection 4-A, with a total cost of less than $2,000,000, and the state board may not give final approval to a school construction project, except a small scale school construction project as defined in section 15901, subsection 4-A, must receive unless the project receives a favorable vote conducted in accordance with the following this section.

This bill requires approval in a local vote before a school administrative unit may spend any funds on a school construction project other than a small scale school construction project with a total cost of less than $2,000,000.
