Amend the bill in section 1 in §2013 by striking out all of subsection 4 and inserting the following:

4 Penalties.   The following penalties apply.
A A person who violates this section commits a civil violation for which a fine of not more than $2,500 may be adjudged.
B A person who violates this section after having previously violated this section commits a civil violation for which a fine of not more than $5,000 may be adjudged.

SUMMARY

This amendment is the majority report of the Joint Standing Committee on Criminal Justice and Public Safety. The amendment reduces the penalty provision from $10,000 per violation, instead specifying that a person who violates the background check requirements commits a civil violation for which a fine of not more than $2,500 may be adjudged for a first violation and a fine of not more than $5,000 may be adjudged for a 2nd or subsequent violation.
