Resolve, Implementing the Recommendations of the Commission To Study the Incidence of and Mortality Related to Cancer

Emergency preamble. Whereas,  acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and

Whereas,  this legislation needs to take effect before the expiration of the 90-day period in order to allow the Commission To Study the Incidence of and Mortality Related to Cancer sufficient time to conduct its work; and

Whereas,  in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore, be it

Sec. A-1. Resolve 2013, c. 77, §9, amended. Resolved: That Resolve 2013, chapter 77, section 9 is amended to read:

Sec. 9. Reports. Resolved: That, no later than December 4   15, 2013, the commission shall submit a  an interim report that includes its findings and recommendations, including suggested legislation, to the Joint Standing Committee on Health and Human Services in the Second Regular Session of the 126th Legislature and, no later than December 15, 2014, a final report that includes its findings and recommendations, including suggested legislation, to the joint standing committee of the Legislature having jurisdiction over health and human services matters in the First Regular Session of the 127th Legislature; and be it further

Sec. A-2. Retroactivity. Resolved: That this Part applies retroactively to December 4, 2013.

Sec. B-1. Working group. Resolved: That the Commissioner of Health and Human Services, in conjunction with the Director of the Maine Center for Disease Control and Prevention within the Department of Health and Human Services and the Commissioner of Education, shall convene a working group to develop a long-term, evidence-based strategy to prevent obesity as a significant preventable risk factor for cancer; and be it further

Sec. B-2. Participants. Resolved: That the Commissioner of Health and Human Services shall invite the participation of various stakeholders in the working group under this Part; and be it further

Sec. B-3. Report. Resolved: That, by February 1, 2015, the Commissioner of Health and Human Services shall submit a written report of the working group's findings under this Part and any recommendations, including suggested legislation, to the joint standing committee of the Legislature having jurisdiction over health and human services matters and the joint standing committee of the Legislature having jurisdiction over education matters. The joint standing committees may each submit a bill to the First Regular Session of the 127th Legislature relating to the subject matter of the report.

Emergency clause. In view of the emergency cited in the preamble, this legislation takes effect when approved.

SUMMARY

This resolve requires the Commission To Study the Incidence of and Mortality Related to Cancer to complete an interim report and extends the date for the final report to December 15, 2014.

This resolve also directs the Commissioner of Health and Human Services, in conjunction with the Director of the Maine Center for Disease Control and Prevention within the Department of Health and Human Services and the Commissioner of Education, to convene a working group to develop a long-term, evidenced-based strategy to prevent obesity as a significant risk factor for cancer.
