An Act To Delay Implementation of the Maine Metallic Mineral Mining Act and Related Statutory Provisions
Emergency preamble. Whereas, acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and
Whereas, Public Law 2011, chapter 653 established the Maine Metallic Mineral Mining Act and made other changes to the Maine Revised Statutes related to the establishment of that Act; and
Whereas, the Act and the related changes have a delayed effective date of June 1, 2014; and
Whereas, it is necessary to delay implementation of the Act; and
Whereas, the 90-day period will expire after June 1, 2014; and
Whereas, in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore,
Sec. 1. PL 2011, c. 653, §33 is amended to read:
Sec. 33. Effective date. Those sections of this Act that amend the Maine Revised Statutes, Title 12, Title 36 and Title 38 take effect June 1, 2014 2016.
Emergency clause. In view of the emergency cited in the preamble, this legislation takes effect when approved.
SUMMARY
This bill is reported out by the Joint Standing Committee on Environment and Natural Resources pursuant to Joint Order 2013, S.P. 742. This bill amends Public Law 2011, chapter 653, section 33 to delay implementation of the Maine Metallic Mineral Mining Act and related statutory provisions for 2 years, with a new effective date of June 1, 2016.
