Amend the bill by striking out everything after the enacting clause and before the summary and inserting the following:

Sec. 1. 29-A MRSA §2522, sub-§2-A  is enacted to read:

2-A Mandatory test.   The Department of Health and Human Services shall test blood samples obtained under subsection 2 to determine the blood-alcohol level and the presence of any drug or drug metabolite and report the test results to the Department of Public Safety, Bureau of Highway Safety.

Sec. 2. Appropriations and allocations. The following appropriations and allocations are made.

Initiative: Provides funding to conduct blood tests to determine the blood-alcohol level and the presence of any drug or drug metabolite for accidents involving a fatality.

Sec. . Effective date. This Act takes effect July 1, 2016.’

SUMMARY

This amendment replaces the bill and requires the Department of Health and Human Services to test blood samples of the operator of a motor vehicle involved in an accident that results in, or may result in, death to determine the blood-alcohol level and the presence of any drug or drug metabolite and report the test results to the Department of Public Safety, Bureau of Highway Safety. This amendment delays the effective date of the bill until July 1, 2016. The amendment adds an appropriations and allocations section.
