An Act To Protect Private Property and Livestock from Fireworks

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 8 MRSA §223-A, sub-§8, ¶¶C and D  are enacted to read:

C A person may not use consumer fireworks where noise from the fireworks would disturb livestock or poultry or within 1/4 mile of a property where livestock or poultry are present without the consent of that property's owner. As used in this paragraph, "livestock" has the same meaning as in Title 7, section 81, subsection 8 and "poultry" has the same meaning as in Title 7, section 81, subsection 9.
D A person may not allow debris from the use of consumer fireworks to enter or land on the property of a person who has not given consent for the debris to enter or land on that property.

This bill prohibits the use of consumer fireworks where noise from the fireworks would disturb livestock or poultry or within 1/4 mile of a property where livestock or poultry are present without the consent of that property's owner and prohibits a person from allowing debris from the use of consumer fireworks to enter or land on the property of a person who has not given consent for the debris to enter or land on the property.
