An Act Regarding Learner's Permits for Driver's Licenses

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 29-A MRSA §1304, sub-§1, ¶B,  as amended by PL 2013, c. 381, Pt. B, §16, is further amended to read:

B. After an applicant has successfully passed all parts of an examination other than the driving test, the Secretary of State , the Secretary of State's designee or a person licensed as a driver education instructor under section 1354, subsection 2 may issue a learner's permit.

Sec. 2. 29-A MRSA §1304, sub-§1-A,  as enacted by PL 2013, c. 493, §1, is amended to read:

1-A. Learner's permit; issuance.  The following provisions apply to the issuance of a learner's permit.
A. Fees for a learner's permit may be collected only by the Secretary of State , the Secretary of State's designee or a person licensed as a driver education instructor under section 1354, subsection 2 in accordance with section 154, subsection 1.
B. Any required application materials for a learner's permit may be collected only by the Secretary of State , the Secretary of State's designee or a person licensed as a driver education instructor under section 1354, subsection 2.
C. Any required examination for a learner's permit may be administered only by the Secretary of State , the Secretary of State's designee or a person licensed as a driver education instructor under section 1354, subsection 2.
D. A learner's permit may be issued only by the Secretary of State , the Secretary of State's designee or a person licensed as a driver education instructor under section 1354, subsection 2.

summary

This bill allows a designee of the Secretary of State or a person licensed as a driver education instructor to do the following:

1. Collect fees for a learner's permit for a driver's license;

2. Collect application materials for a learner's permit;

3. Administer an examination for a learner's permit; and

4. Issue a learner's permit.

Current law allows only the Secretary of State to perform these functions.
