An Act To Allow Overhead Garage Door Installers To Install and Repair Dumbwaiters

Sec. 1. 32 MRSA §15208-A,  as amended by PL 2013, c. 70, Pt. D, §13, is further amended by adding at the end a new paragraph to read:

This section does not apply to a person, firm, partnership, association, corporation or company whose primary business is the installation or servicing of overhead garage doors or overhead garage door openers that also engages in the business of servicing, repairing, altering or installing dumbwaiters used only for the transportation of inanimate goods.

Sec. 2. 32 MRSA §15213, first ¶,  as amended by PL 2013, c. 70, Pt. D, §20, is further amended to read:

A person may not service, repair, alter or install any elevator unless that person is licensed as an elevator or lift mechanic under this chapter , except that a person who installs or services overhead garage doors or overhead garage door openers may service, repair, alter and install dumbwaiters used only for the transportation of inanimate goods without being so licensed. Elevator work in industrial plants and manufacturing plants may be performed by plant personnel who are not licensed under this chapter if the work is supervised by the plant engineer and performed in compliance with rules adopted by the director.

SUMMARY

This bill allows a person who installs or services overhead garage doors or openers to install and repair dumbwaiters used only for the transportation of inanimate goods without being licensed as an elevator or lift mechanic and exempts a company that installs or services overhead garage doors or openers from having to register as an elevator contractor in order to install or service dumbwaiters used only for the transportation of inanimate goods.
