Amend the amendment by striking out the substitute title and replacing it with the following:

‘An Act Regarding the Penalty for Aggravated Sex Trafficking’

Amend the amendment by striking out all of sections 1 to 4 (page 1, lines 16 to 33 and page 2, lines 1 to 3 in amendment) and inserting the following:

Sec. 1. 17-A MRSA §852, sub-§4  is enacted to read:

4   The court, in determining the appropriate sentence of a person convicted of a violation of subsection 1, paragraph B, shall treat the age of the person promoted into prostitution as an aggravating sentencing factor.

SUMMARY

This amendment removes the penalty increases contained in the bill, as amended by Committee Amendment "A," and instead, with respect to the crime of sex trafficking of a person less than 18 years of age, directs the court to treat the age of the person trafficked as an aggravating sentencing factor.
