Amend the bill by striking out everything after the enacting clause and before the summary and inserting the following:

Sec. 1. 22 MRSA §3104, sub-§13-A  is enacted to read:

13-A Broad-based categorical eligibility for the elderly and disabled.   The department shall confer broad-based categorical eligibility for food supplement benefits, without regard to a household's assets, for households not included in subsection 13 that have an elderly or disabled member and gross income equal to or below 185% of the nonfarm income official poverty level as provided for in 7 United States Code, Section 2014. For the purposes of this subsection, "elderly or disabled member" has the same meaning as in the federal Food and Nutrition Act of 2008, 7 United States Code, Section 2012(j).

Sec. 2. Appropriations and allocations. The following appropriations and allocations are made.

Initiative: Provides an appropriation and allocation for development and testing related to technology changes to the Automated Client Eligibility System.

summary

This amendment replaces the bill and is the majority report of the committee. It provides for broad-based categorical eligibility for food supplement benefits for households that have an elderly or disabled member. It provides that the eligibility for such a household is not subject to an asset test and is based only on the gross income of the household.

This amendment also adds an appropriations and allocations section.
