Resolve, To Redispense Donated Prescription Drugs
Sec. 1. Donation and redispensing of unused prescription drugs. Resolved: That the Maine Board of Pharmacy, established in the Maine Revised Statutes, Title 32, chapter 117, shall adopt rules to allow a nongovernmental organization in the State to coordinate both the donation of unused prescription drugs by nursing homes, hospitals, wholesalers and other institutional pharmacies and the subsequent redispensing of these prescription drugs at no cost to low-income residents of the State, subject to the following provisions.
1. Prescriptions for donated drugs under this section must be filled by pharmacists licensed in the State for patients in the State who are prequalified by the coordinating organization.
2. Donated prescription drugs must be evaluated for suitability for redispensing and then stored, redispensed or destroyed in accordance with existing laws and Maine Board of Pharmacy rules.
3. An extended hospital pharmacy, as described in Maine Board of Pharmacy rule Chapter 35, may accept, store, redispense or destroy donated prescription drugs prescribed for patients in the State.
Rules adopted pursuant to this resolve are routine technical rules as defined in the Maine Revised Statutes, Title 5, chapter 375, subchapter 2-A.
SUMMARY
This resolve requires the Maine Board of Pharmacy to adopt rules to allow a nongovernmental organization in the State to coordinate both the donation of unused prescription drugs by nursing homes, hospitals, wholesalers and other institutional pharmacies and the subsequent redispensing of these prescription drugs at no cost to low-income residents of the State.
