An Act To Exempt Small Bottlers from the Bottling Plant Requirements
Emergency preamble. Whereas, acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and
Whereas, this legislation must take effect before the expiration of the 90-day period in order to provide timely support to a number of small bottling businesses in the State that are in the early stages of development; and
Whereas, in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore,
Sec. 1. 32 MRSA §1852 is amended by adding at the end a new paragraph to read:
This section does not apply to beverage plants preparing, manufacturing or bottling up to 10,000 gallons of beverages per year.
Emergency clause. In view of the emergency cited in the preamble, this legislation takes effect when approved.
SUMMARY
This bill exempts beverage plants bottling up to 10,000 gallons of beverages per year from the law governing beverage plants.
