Amend the bill in section 1 in subsection 8 in the first paragraph in the last line (page 1, line 6 in L.D.) by inserting after the following: " dealer" the following: ' , loaner'
Amend the bill in section 1 in subsection 8 in paragraph C by striking out all of subparagraph (1) (page 1, lines 13 to 15 in L.D.) and inserting the following:
‘ (1) A registered owner may not be charged with eluding a police officer pursuant to subsection 3 if, at the time of the violation, another person is operating the vehicle and, when asked by a law enforcement officer, the registered owner discloses the name of the operator of the vehicle.

SUMMARY
This amendment is the majority report of the committee. Like the bill, the amendment provides a defense to prosecution for an owner of a vehicle if a person other than the owner is charged with eluding a law enforcement officer. The amendment adds to the provision that, if asked by a law enforcement officer, the owner must disclose the name of the operator of the vehicle. The amendment extends the defense available to a dealer or transporter to a dealer who loans the vehicle using loaner plates.
