An Act Regarding Transportation Management Software and School Bus Replacement

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 20-A MRSA §5401, sub-§15, ¶E  is enacted to read:

E Notwithstanding any other provision of this subsection, the commissioner shall approve a request submitted by a school administrative unit to replace a conventional school bus or transit-style school bus if the bus has:

(1) At least 150,000 accumulated miles; and

(2) Been in operation for 10 or more years, as determined by the commissioner.

The commissioner shall by rule define "conventional school bus" and "transit-style school bus." Rules adopted pursuant to this paragraph are routine technical rules as defined in Title 5, chapter 375, subchapter 2-A.

Sec. 2. 20-A MRSA §5401, sub-§18  is enacted to read:

18 School transportation operations.   The department may not require a school administrative unit to use a specific brand of routing and transportation management software.

This bill establishes in statute the criteria for the replacement of conventional and transit-style school buses through the Department of Education and prohibits the department from requiring a school administrative unit to use a specific brand of routing and transportation management software.
