An Act To Prohibit the Sale of Motor Fuel Containing More than 10% Ethanol
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 10 MRSA §1457-C is enacted to read:
§ 1457-C. Prohibition on sale, consignment or distribution of motor fuel containing more than 10% ethanol by volume
1. Prohibition. Notwithstanding any other provision of law to the contrary, except as provided in subsection 2, a distributor, blender or retail dealer may not sell, consign or distribute motor fuel containing more than 10% ethanol by volume.
2. Exception. A distributor, blender or retail dealer may sell, consign or distribute motor fuel containing more than 10% ethanol by volume if the motor fuel is sold, consigned or distributed in a sealed container that contains one quart or less of the motor fuel.
Sec. 2. 38 MRSA §585-M, as enacted by PL 2013, c. 69, §1, is repealed.

This bill prohibits a distributor, blender or retail dealer from selling, consigning or distributing motor fuel containing more than 10% ethanol by volume unless the motor fuel is sold, consigned or distributed in a sealed container that contains one quart or less of the motor fuel. It also repeals a contingent prohibition on the sale of motor fuel containing more than 10% ethanol by volume.
