An Act To Restrict Cell Phone Use by Students While in School

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 20-A MRSA §4013  is enacted to read:

§ 4013 Cellular telephone use

The department shall adopt major substantive rules as defined in Title 5, chapter 375, subchapter 2-A that prohibit the use of a cellular telephone by a student in a public school during classroom time, lunch breaks or transition time between classes and that allow a student who has an emergency to use a cellular telephone in the main office of the school. A school administrative unit may adopt a policy to implement the department's rules as long as that policy is at least as restrictive as the department's rules.

This bill requires the Department of Education to adopt major substantive rules restricting the use of cellular telephones by students.
