An Act To Ensure Compliance with Federal Family First Prevention Services Legislation
Be it enacted by the People of the State of Maine as follows:
Sec. 1. 22 MRSA §8102, sub-§1, ¶¶C and D, as repealed and replaced by PL 1981, c. 260, §4, are amended to read:
C. The nature, provision, documentation and management of programs of care or treatment; and
D. The physical environment . ; and
Sec. 2. 22 MRSA §8102, sub-§1, ¶E is enacted to read:
E. Procedures for fingerprint-based criminal history record checks of national crime information databases, as defined in 28 United States Code, Section 534(f)(3)(A), and child abuse and neglect registry checks for all staff working in the facility.
SUMMARY
This bill requires the Department of Health and Human Services to adopt rules for children’s residential care facilities that include procedures for fingerprint-based background checks and child abuse and neglect registry checks for all staff working in the facility to ensure compliance with the requirements governing fingerprint-based background checks contained in federal family first prevention services legislation.
