An Act To Address the Needs of Pregnant Women Affected by Opioid Use Disorder

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 22 MRSA §1728  is enacted to read:

§ 1728 Grant program for treatment of pregnant women with opioid use disorder

1 Program.   The department shall administer a program to provide grants to entities that provide treatment for pregnant women with opioid use disorder.
2 Department duties.   In administering the program under subsection 1, the department shall develop:
A Eligibility criteria for grant recipients;
B A process for reviewing applications and selecting grant recipients;
C Criteria for prioritizing grant applications;
D Standards for treatment conducted under a grant; and
E A program evaluation process and measures for assessing the impact and effectiveness of the grant program.
3 Fund established.   The Fund for the Treatment of Pregnant Women with Opioid Use Disorder is established as a dedicated, nonlapsing fund within the department. The department may accept funds from any public or private source for the purposes of awarding grants and administering the grant program under this section.
4 Rulemaking.   The department shall adopt rules to implement this section. Rules adopted in accordance with this subsection are routine technical rules as defined in Title 5, chapter 375, subchapter 2-A.

Sec. 2. Transfer from General Fund unappropriated surplus to the Fund for the Treatment of Pregnant Women with Opioid Use Disorder. Notwithstanding any provision of law to the contrary, the State Controller shall transfer $1,000,000 from the General Fund unappropriated surplus to the Fund for the Treatment of Pregnant Women with Opioid Use Disorder established within the Department of Health and Human Services pursuant to the Maine Revised Statutes, Title 22, section 1728, subsection 3 to be used for the purposes of that fund.

SUMMARY

This bill directs the Department of Health and Human Services to administer a program to provide grants for the treatment of pregnant women with opioid use disorder. It establishes the Fund for the Treatment of Pregnant Women with Opioid Use Disorder and directs the State Controller to transfer $1,000,000 from the General Fund unappropriated surplus to that fund.
