Amend the resolve by striking out everything after the emergency preamble and before the emergency clause and inserting the following:

‘Sec. 1. Adoption. Resolved: That final adoption of portions of Chapter 100: Enforcement Procedures, a provisionally adopted major substantive rule of the Maine Health Data Organization that has been submitted to the Legislature for review pursuant to the Maine Revised Statutes, Title 5, chapter 375, subchapter 2-A, is authorized only if the following change is made.

1. The rule must be amended in Section 2 in paragraph M to change the cross-reference in the definition of "pharmacy benefits manager" to Title 24-A, section 4347, subsection 17.

The Maine Health Data Organization is not required to hold hearings or undertake further proceedings prior to the final adoption of the rule in accordance with this section.’

Amend the resolve by relettering or renumbering any nonconsecutive Part letter or section number to read consecutively.

This amendment provides that final adoption of portions of Chapter 100: Enforcement Procedures, a provisionally adopted major substantive rule of the Maine Health Data Organization, is authorized only if the organization corrects a cross-reference to a statutory definition used in the rule prior to final adoption.
