Amend the bill in section 1 in subsection 9 in the 3rd to 5th lines (page 1, lines 5 to 7 in L.D.) by striking out the following: " , gender identity or gender expression or to statements, consensual sexual conduct or consensual acts relating to sexual orientation, gender identity or gender expression" and inserting the following: ' or gender identity or to statements, consensual sexual conduct or consensual acts relating to sexual orientation or gender identity'
Amend the bill in section 1 in subsection 9 in paragraph D in the first line (page 1, line 29 in L.D.) by inserting after the following: " subsection," the following: ' "gender identity" has the same meaning as in Title 5, section 4553, subsection 5-C; "sexual orientation" has the same meaning as in Title 5, section 4553, subsection 9-C; and'
Amend the bill in section 2 in the first line (page 1, line 32 in L.D.) by striking out the following: "PL 2007, c. 521, §1" and inserting the following: 'PL 2019, c. 601, §1'
Amend the bill in section 3 in the 8th line (page 2, line 2 in L.D.) by striking out the following: "January" and inserting the following: 'May'
Summary
This amendment cross-references the definitions of "gender identity" and "sexual orientation" in the Maine Human Rights Act. Because "sexual orientation" is defined to include gender expression in that Act, the amendment also strikes unnecessary references to gender expression from the bill.
The amendment further changes, from January 15, 2021 to May 15, 2021, the date by which the Director of the Maine Bureau of Veterans' Services within the Department of Defense, Veterans and Emergency Management must submit a report on the potential for implementing a process to review for state benefits purposes the discharge status of veterans who have been diagnosed with post-traumatic stress disorder, traumatic brain injury or psychological trauma resulting from sexual assault or sexual harassment during military service.
