An Act Regarding the Maine Law Enforcement Memorial

Be it enacted by the People of the State of Maine as follows:

Sec. 1. 25 MRSA §2917  is enacted to read:

§ 2917 Eligibility for law enforcement memorial

1 Definitions.   As used in this section, unless the context otherwise indicates, the following terms have the following meanings.
A "Killed in the line of duty" means died as a direct and proximate result of a personal injury sustained while undertaking any action that the deceased law enforcement officer was obligated or authorized to perform by law, rule, regulation or written condition of employment as a law enforcement officer or for which the law enforcement officer was compensated by the public entity employing the law enforcement officer.
B "Law enforcement officer" has the same meaning as in Title 29-A, section 101, subsection 30.
2 Eligibility.   A deceased law enforcement officer's name is eligible to be included on the law enforcement memorial located at the State Capitol complex if:
A The law enforcement officer was killed in the line of duty and at the time of death was a resident of the State or employed as a law enforcement officer in the State; and
B The law enforcement officer's:

(1) Name is approved for inclusion in the National Law Enforcement Officers Memorial in Washington, D.C.; or

(2) Death meets the criteria for benefits under section 1612.

3 Application process.   Upon application, the commissioner shall add a name of a law enforcement officer eligible under subsection 2 to the law enforcement memorial located at the State Capitol complex. An application under this subsection must include a letter detailing the correct spelling of the law enforcement officer's name and official documentation that the requirement of subsection 2, paragraph B, subparagraph (1) or (2) has been met.

SUMMARY

This bill requires the Commissioner of Public Safety to add to the list of names on the law enforcement memorial located at the State Capitol complex the name of a law enforcement officer who was killed in the line of duty, who at the time of death was a resident of the State or employed in the State as a law enforcement officer and whose name is approved for inclusion on the National Law Enforcement Officers Memorial or whose death meets the criteria for line-of-duty death benefits.
